Since CBD oil and infusions are still in a legal gray area, this guide gives a general overview of CBD food regulations for restaurants so you can decide if you want to incorporate these foods into your menu.<\/span><\/p>\n<h2><strong>What is CBD?<\/strong><\/h2>\n<p>\u201cCBD\u201d is an acronym for cannabidiol, a naturally-occurring compound of the cannabis plant. Despite its source, <strong>CBD does not contain THC<\/strong>, the well-known, mind-altering compound also found in cannabis, which produces a \u201chigh.\u201d Since entering the market, CBD has been credited as an all-natural supplement for alleviating everyday muscle pains, joint aches and migraines. CBD is also legally used as a medication for two rare forms of epilepsy<\/p>\n<p>Once the CBD market really began to boom in 2019, it\u2019s been a main ingredient in drinks, snacks, food bars and more. In the culinary world, chefs and mixologists have been experimenting with CBD oil infusions or tinctures to give their menus an extra oomph.<\/p>\n<h2><strong>Is CBD Legal?<\/strong><\/h2>\n<p>Technically, yes, because CBD is a product of hemp, which was legalized in the 2018 Farm Bill. While CBD is a legal substance to have, it is not legal to sell as a supplement with unsubstantiated claims as an anxiety reducer or a pain reliever. It\u2019s also technically illegal to sell it in food products, unless stated otherwise by your local state or county legislation.<\/p>\n<p>The FDA is still trying to establish set guidelines about selling of CBD and its usage. According to a FAQ posted on the <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\" target=\"_blank\" rel=\"noopener\">FDA\u2019s official site<\/a>, they have this to say about whether or not CBD is legal to sell:<\/p>\n<p>\u201cIt depends, among other things, on the intended use of the product and how it is labeled and marketed. Even if a CBD product meets the definition of \u2018hemp\u2019 under the 2018 Farm Bill&#8230;it still must comply with all other applicable laws, including the FD&amp;C Act.\u201d<\/p>\n<p>Additionally, CBD-infused food products are prohibited from interstate commerce according to the FDA.<\/p>\n<h2><strong>Can I Use CBD in My Restaurant?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.fsrmagazine.com\/feature\/can-you-really-use-cbd-your-restaurant\/\"><span style=\"font-weight: 400;\">legality of CBD foods<\/span><\/a><span style=\"font-weight: 400;\"> depends on where your restaurant is located. Each state has its own unique stance on the usage of CBD and how it&#8217;s sold, so you\u2019ll have to check on your state\u2019s stance and see how it applies to your business.<\/span><\/p>\n<h2><strong>What Should I Do if I Have CBD on My Menu? <\/strong><\/h2>\n<p>First, until you know for sure whether you can sell CBD products on your menu, it\u2019s best to err on the side of caution and remove the item from your menu. Should you sell CBD-infused products on your menu in an area where it\u2019s prohibited, you could run the risk of being penalized by the FDA.<\/p>\n<p>Next, if it is legal to sell CBD products in your restaurant, make sure you follow any corresponding legislation on selling such products. If you have a lawyer you work with, it would be good to get their advice and learn of any limitations.<\/p>\n<p>However, if you do have to remove your CBD menu items, you can use other legal hemp products like hemp seed, which provide many added health benefits.<\/p>\n<p><span style=\"font-weight: 400;\">While it may seem like working with CBD is a bit tricky, the <\/span><a href=\"https:\/\/www.fda.gov\/consumers\/consumer-updates\/what-you-need-know-and-what-were-working-find-out-about-products-containing-cannabis-or-cannabis\"><span style=\"font-weight: 400;\">FDA CBD guidelines<\/span><\/a><span style=\"font-weight: 400;\"> are a good place to go if you want the most up-to-date information.
