{"id":16631,"date":"2023-03-20T09:01:41","date_gmt":"2023-03-20T14:01:41","guid":{"rendered":"https:\/\/www.partstown.com\/about-us\/?p=16631"},"modified":"2023-12-13T09:19:43","modified_gmt":"2023-12-13T15:19:43","slug":"food-waste-laws","status":"publish","type":"post","link":"https:\/\/www.partstown.com\/about-us\/food-waste-laws","title":{"rendered":"Food Waste Laws By State"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">There\u2019s enough food in the United States to feed every single one of its inhabitants, and yet, there are still <\/span><a href=\"https:\/\/www.feedingamerica.org\/hunger-in-america\"><span style=\"font-weight: 400;\">34 million people<\/span><\/a><span style=\"font-weight: 400;\"> in the United States suffering from food insecurity. Still, <\/span><a href=\"https:\/\/www.feedingamerica.org\/our-work\/reduce-food-waste\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">119 billion pounds<\/span><\/a><span style=\"font-weight: 400;\"> of food are wasted every year. Yet that\u2019s more than enough to feed 34 million people 3 square meals a day. Stopping food waste is the first step to ending hunger, so let\u2019s take a look at the list of states that have implemented food waste laws to keep this valuable resource out of landfills and its byproducts out of the ozone.<\/span><\/p>\n<h2><strong>State Food Waste Laws\u00a0<\/strong><\/h2>\n<h3><strong><em>California\u00a0<\/em><\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">Perhaps the most progressive and strictest of the states with <\/span><a href=\"https:\/\/www.law.cornell.edu\/regulations\/california\/14-CCR-18986.3\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Food Waste Laws<\/span><\/a><span style=\"font-weight: 400;\">, California requires all its inhabitants, whether they be commercial businesses, public institutes or private residents to separate their green waste. Tier 1 food generators are required to donate any edible waste to a food recovery organization and recycle the rest at an organic waste collection service either by self-hauling or subscribing, while tier 2 food generators are required to comply on January 1, 2024.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Tier 1 food waste generators<\/strong><span style=\"font-weight: 400;\"> \u2013 Grocery stores and wholesale food vendors, food providers and food distributors\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>Tier 2 food waste generators<\/strong><span style=\"font-weight: 400;\"> \u2013 Restaurants, state agencies, large venues and events, hotels, health facilities and local educational institutions<\/span><\/li>\n<\/ul>\n<h3><em><strong>Colorado\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Technically, Colorado doesn\u2019t have a state-wide food waste law, but the city of Boulder has put a <\/span><a href=\"https:\/\/bouldercolorado.gov\/services\/universal-zero-waste-ordinance\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Universal Zero Waste Ordinance<\/span><\/a><span style=\"font-weight: 400;\"> in place that states:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Property and business owners must separate organic, recycling and regular trash and place them in the appropriate containers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Business and property owners can apply for a waiver if they can prove that they produce less than 1,000 pounds of organic waste annually, can\u2019t afford it or don\u2019t have space for it. However, the waiver only lasts one year, so an annual reapplication is required<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Have signs displayed labeling compost, kitchen compost, landfill and recycling<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Business owners have to train their employees on how to sort their trash<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Property owners have to inform renters about trash bin locations<\/span><\/li>\n<\/ul>\n<h3><em><strong>Connecticut\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">As of January 1, 2022, Connecticut passed a <\/span><a href=\"https:\/\/portal.ct.gov\/DEEP\/Waste-Management-and-Disposal\/Organics-Recycling\/Commercial-Organics-Recycling-Law\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Commercial Organics Recycling Law<\/span><\/a><span style=\"font-weight: 400;\"> that states that if you fall under one of the businesses listed below and produce over 26 tons of organic waste per year, then they will have to separate their food waste to be disposed of at an organic waste facility. You may be exempt if your establishment is located outside a 20-mile radius of the nearest organic food waste facility. Connecticut food waste law applies to the following who meet the above criteria:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Food wholesalers and distributors\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Industrial food manufacturers and processors\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Supermarkets<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Resorts\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Conference centers<\/span><\/li>\n<\/ul>\n<h3><em><strong>Hawaii\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Hawaii is another one of those states that don\u2019t have a state-wide food waste law except for the city of Honolulu, which has enacted a <\/span><a href=\"https:\/\/www1.honolulu.gov\/opalaforms\/Food%20Waste%20Tip%20Sheet%202021.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Municipal Waste Ban<\/span><\/a><span style=\"font-weight: 400;\">. The law states that food establishments, manufacturers and processors who fall under the following classifications have to separate food waste to be recycled at an organic recycling facility. Those affected by the Honolulu food waste law are:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A restaurant that is over 5,000 square feet or prepares over 400 meals a day\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A food court with 5 or more foodservice businesses<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A hotel with one or more than one kitchen\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A food manufacturer or processor that is over 5,000 square feet\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A catering business that prepares over 400 meals a day\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A hospital that prepares over 400 meals a day\u00a0<\/span><\/li>\n<\/ul>\n<h3><em><strong>Maryland\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Maryland has recently passed legislation titled <\/span><a href=\"https:\/\/mde.maryland.gov\/programs\/land\/RecyclingandOperationsprogram\/Pages\/Solid-Waste-Management---Organics-Recycling-and-Waste-Diversion---Food-Residuals.aspx#who\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Solid Waste Management<\/span><\/a><span style=\"font-weight: 400;\"> mandating that anyone, whether that be an individual household, business, cafeteria, grocery store, etc., producing over 2 tons of organic waste a week must separate their organic trash to prevent it from ending up in landfills. Some of the key takeaways from Maryland\u2019s food waste laws are:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This law does not apply to restaurants that serve the public.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Anyone who can prove that diverting their organic waste costs 10% more than sending it to a landfill or is outside a 30-mile radius of an organic recycling facility can request a waiver.<\/span><\/li>\n<\/ul>\n<h3><em><strong>Massachusetts\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Following their lead, Massachusetts implemented a <\/span><a href=\"https:\/\/www.mass.gov\/guides\/commercial-food-material-disposal-ban\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Commercial Food Material Disposal Ban<\/span><\/a><span style=\"font-weight: 400;\"> to enforce businesses producing more than \u00bd tons of organic waste per week to separate and dispose of their food waste at an organic waste facility. Businesses are required to participate regardless of their distance from the waste disposal site.\u00a0<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-16633 aligncenter\" src=\"https:\/\/www.partstown.com\/about-us\/wp-content\/uploads\/2023\/03\/Woman-sorting-her-green-waste-food-waste-laws.jpg\" alt=\"Woman sorting her green waste-food waste laws\" width=\"1000\" height=\"606\" \/><\/p>\n<h3><em><strong>Minnesota\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Minnesota doesn\u2019t enforce a state-wide food waste disposal ban, except within <\/span><a href=\"https:\/\/www.hennepin.us\/-\/media\/hennepinus\/your-government\/ordinances\/ordinance-13.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Hennepin county<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/wlssd.com\/wp-content\/uploads\/2018\/09\/12T214403-Revised-2014-Solid-Waste-Ordin-Aug-18_CLEAN.pdf#page=46\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Western Lake Superior Sanitary District<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h4><strong><em>Hennepin County\u00a0<\/em><\/strong><\/h4>\n<p><span style=\"font-weight: 400;\">Hennepin County requires most all commercial businesses that generate more than one ton of trash per week or contract for 8 cubic yards or more per week to separate and dispose of their back-of-house food waste by either self-hauling or subscribing to an organic <a href=\"https:\/\/www.partstown.com\/cm\/resource-center\/guides\/gd2\/how-to-reduce-food-waste-in-restaurants\">food waste<\/a> disposal service.<\/span><\/p>\n<h4><strong><em>Western Lake Superior Sanitary District\u00a0<\/em><\/strong><\/h4>\n<p><span style=\"font-weight: 400;\">The following establishments are obligated to separate their organic waste for pick up by a recovery service:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grocery stores or commercial establishments over 5,000 square feet<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Restaurant or catering business with a category 3 establishment food handling license\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Post-secondary schools that provide on-site meals with an enrollment of over 1,000 full-time students\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hospitals or nursing homes that provide onsite meals\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A food manufacturer or processor over 5,000 square feet\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An assisted living facility\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A correctional facility\u00a0<\/span><\/li>\n<\/ul>\n<h3><em><strong>New Jersey\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">New Jersey enjoys a <\/span><a href=\"https:\/\/www.nj.gov\/dep\/dshw\/food-waste-recycling-law\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Food Waste Recycling and Food Waste-to-Energy Production Law<\/span><\/a><span style=\"font-weight: 400;\"> that requires all large food waste generators to separate and dispose of their organic material at an authorized food waste recycling facility. Those affected by the law are those establishments, such as commercial food wholesalers and distributors, hospitals, restaurants, supermarkets, etc., which generate 52 tons of food waste or more every year. This number does not include plate waste and food donations.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An exception is made for establishments outside a 25-mile radius of an authorized food waste recycling facility. An exception is also granted if the cost of transporting the organic waste, including the facility fee, is 10% more than it would cost to use a solid waste disposal facility.<\/span><\/p>\n<h3><em><strong>New York\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">New York has recently implemented a <\/span><a href=\"https:\/\/www.dec.ny.gov\/chemical\/114499.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Food Donation and Food Scraps Recycling Law<\/span><\/a><span style=\"font-weight: 400;\">, applying to businesses that produce up to 2 tons of wasted food or more every week. To abide by this law, food scrap generators have to either donate spare food and\/or dispose of food waste at an organics recycler.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Waivers are granted to business entities dwelling outside a 25-mile radius of a disposal center, but waivers must be reapplied annually. The law exempts New York City (which is covered under its own law), nursing homes, adult care facilities, hospitals and primary and secondary schools.<\/span><\/p>\n<h4><em><strong>New York City Law\u00a0<\/strong><\/em><\/h4>\n<p><span style=\"font-weight: 400;\">New York City has a separate <\/span><a href=\"https:\/\/www.nyc.gov\/assets\/dsny\/site\/services\/food-scraps-and-yard-waste-page\/commercial-requirements\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Commercial Organics Rule<\/span><\/a><span style=\"font-weight: 400;\"> that is slightly more comprehensive. It states that affected businesses have to separate back-of-house food waste and either transport it themselves or arrange for private pick-up to be processed on-site at an organic waste facility.<\/span><\/p>\n<h3><em><strong>Oregon<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Unfortunately, Oregon doesn\u2019t prescribe state-wide food waste laws, but it\u2019s taken a step in the right direction with <\/span><a href=\"https:\/\/www.portland.gov\/bps\/garbage-recycling\/business-garbage-policies\/food-scraps-requirement\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Portland\u2019s Food Scrap Policy<\/span><\/a><span style=\"font-weight: 400;\">. Businesses that handle food in any way must separate and divert food waste to an authorized processing facility.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In an increased effort to keep food out of the waste stream, Oregon\u2019s metro area has plans set for 2025 that will prohibit any commercial business from throwing its food waste into landfill.\u00a0<\/span><\/p>\n<h3><em><strong>Rhode Island\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Rhode Island is another one of those progressive states that enact a <\/span><a href=\"http:\/\/webserver.rilin.state.ri.us\/Statutes\/TITLE23\/23-18.9\/23-18.9-17.HTM\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Food Waste Ban<\/span><\/a><span style=\"font-weight: 400;\">. Under this law, educational institutions that generate over 30 tons of organic waste per year are obliged to separate their organic material from solid waste to be repurposed at an authorized recycling facility.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Exemptions apply to educational institutions outside a 15-mile radius of the recycling center or if the expense is more than it would be at a landfill processing facility.\u00a0<\/span><\/p>\n<h3><em><strong>Texas\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Texas is again one of those states which doesn\u2019t enact a state-wide food waste ban. However, the foodservice businesses that require a food permit in the city of Austin are required to adopt a <\/span><a href=\"https:\/\/library.municode.com\/TX\/Austin\/codes\/administrative_rules_for_solid_waste_services?nodeId=CH15-6SOWASEDMRU_8.0UNREORURRU\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Zero-Waste Policy<\/span><\/a><span style=\"font-weight: 400;\">. This means all food waste and scraps have to be either composted, donated, sold, diverted to a materials recovery facility or otherwise recycled.\u00a0<\/span><\/p>\n<h3><em><strong>Vermont\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Vermont passed a <\/span><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/10\/159\/06605k\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Universal Recycling Law in 2012<\/span><\/a><span style=\"font-weight: 400;\"> banning food scraps from landfills by commercial businesses and residential households. Instead, food scraps can either be donated for human or animal consumption, composted or diverted to an anaerobic or organic food waste processing facility.<\/span><\/p>\n<h3><em><strong>Washington\u00a0<\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">Washington\u2019s <\/span><a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2021-22\/Pdf\/Bills\/Session%20Laws\/House\/1799-S2.SL.pdf?q=20220706090917\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Food Waste Reduction Act <\/span><\/a><span style=\"font-weight: 400;\">aims to reduce food waste by 50% by the time 2030 rolls around. To stay on track with its goal, Washington is rolling out these changes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>January 1, 2024<\/strong><span style=\"font-weight: 400;\"> \u2013 Businesses generating 8 cubic yards of organic waste per week or more will have to subscribe to an organic waste removal service<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>January 1, 2025<\/strong><span style=\"font-weight: 400;\"> \u2013 Businesses generating 4 cubic yards of organic waste per week or more will have to subscribe to an organic waste removal service<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>January 1, 2027<\/strong><span style=\"font-weight: 400;\"> \u2013 Businesses generating .25 cubic yards or organic waste per week will have to subscribe to an organic waste removal service<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For more information on how to reduce food waste in <\/span><a href=\"https:\/\/www.partstown.com\/cm\/resource-center\/guides\/gd2\/how-to-reduce-food-waste-in-restaurants\"><span style=\"font-weight: 400;\">restaurants <\/span><\/a><span style=\"font-weight: 400;\">and <\/span><a href=\"https:\/\/www.partstown.com\/about-us\/how-to-reduce-food-waste-in-schools\"><span style=\"font-weight: 400;\">schools<\/span><\/a><span style=\"font-weight: 400;\">, check out these additional resources.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>There\u2019s enough food in the United States to feed every single one of its inhabitants, and yet, there are still 34 million people in the United States suffering from food insecurity.
